Condominium Associations Insurance
Board protection where building responsibilities, owner expectations and major repair decisions meet.

Condo association D&O and the building master policy cover different exposures. The master policy's property boundary depends on state law and the declaration; an owner's HO-6 policy has a separate role. D&O should be reviewed for covered allegations about the board's repair, assessment and governance decisions.

Why Condominium Associations Face Distinct Exposure
A condominium board coordinates a building whose ownership and maintenance responsibilities are divided between the association and individual owners. A damaged unit can raise questions about common elements, original fixtures, owner improvements and deductible allocation. Those are property-policy and document questions, not automatic D&O benefits.
A repair program or special assessment can also generate a separate governance allegation: owners may claim the board delayed necessary work, selected a conflicted contractor or failed to follow approval procedures. Review how D&O treats alleged wrongful acts, bodily injury and property damage, contractual disputes and requests for nonmonetary relief. The policy is not a repair budget.
Association records may include owner contact details, payment histories and accommodation information. Management portals and vendor access create cyber concerns. Funds held for operations and reserves call for separate crime/fidelity review, including any applicable lender requirements; these are not the same as employee-benefit fiduciary coverage.
Common Claim Scenarios
Hypothetical examples, not reports of actual claims. Coverage depends on the allegations, facts and policy terms.
Repair oversight challenged
Owners allege directors failed to evaluate maintenance information before approving a repair plan. The allegations and D&O exclusions require review.
Deductible allocation disputed
After a building loss, owners dispute the association's allocation of a deductible. Review state law, the declaration and the relevant property policies.
Contractor conflict alleged
Members question a contract awarded to a director's business and allege inadequate disclosure or approval.
Recommended Coverages
Management liability lines to review against your organization's actual activities and policy terms.
Directors & Officers Insurance
Review protection for directors and the association when repair oversight, assessments or contractor decisions are challenged.
Cyber Liability Insurance
Evaluate incident response and liability for owner records and association-management systems.
Employment Practices Insurance
Consider association-employed staff separately from workers employed by a managing agent or contractor.
What to Think About Before You Buy
Structure matters as much as price. These are the points we walk through with condominium associations before placing coverage.
- Bring the declaration, insurance summary and current master policy to clarify the property boundary.
- Review major repair plans and known owner disputes during underwriting.
- Ask how exclusions affect allegations connected to construction, maintenance or physical damage.
- Review crime/fidelity requirements independently of D&O and cyber coverage.
Condominium Associations Insurance FAQs
What is the difference between a condo master policy and HO-6 insurance?
The association's master policy insures specified building or common-property interests. An owner's HO-6 policy can address personal property, personal liability and defined unit interests. The exact boundary depends on policy language, state law and the declaration; it should not be inferred from the policy names.
Does condo association D&O pay for building repairs?
D&O is liability coverage for covered allegations of wrongful acts, not property insurance or a source of repair funding. Allegations about how directors handled repairs require review of exclusions and covered loss. The fact that a lawsuit names the board does not establish coverage.
Who pays the condo master-policy deductible?
It depends on applicable law, governing documents, facts of the loss and policy terms. Owners should also review any loss-assessment protection in their own policy. Maryland's regulator provides a state-specific example, but its rules should not be applied to every condominium.
Can D&O cover an owner's challenge to a special assessment?
Potentially, if the allegations and requested relief fit the coverage. Check exclusions, insured status, defense costs, notice requirements and how the policy treats financial obligations. A covered defense does not necessarily mean the assessment or requested refund is insured.
Is condo fidelity/crime coverage required?
Requirements can arise from state law, governing documents or lender project standards. Fannie Mae's guidance has defined scope and exceptions; it is not a universal legal mandate. Review the actual funds, who handles them and the current requirements that apply to your project.
