What coverage should you review?

HOA D&O insurance addresses covered allegations about board decisions, not every loss in the neighborhood. General liability and property insurance cover different exposures. Review the declaration, who is insured and how the D&O policy handles owner disputes, defense expenses and notice of claims.

Provident Financial Group is an independent insurance agency. Coverage depends on policy terms, exclusions and the facts. This is general information, not legal advice.

Why Homeowners Associations Face Distinct Exposure

An HOA board sets budgets, collects assessments, oversees common areas and applies community rules. Decisions about a fence, a parking restriction or a renovation can become disputes about whether the board followed the declaration and treated owners consistently. The governance allegation is the reason to examine D&O, not a promise that the dispute will be paid.

The association's property obligations depend on what it owns or maintains. A clubhouse, pool, private road or drainage area can create insurance questions different from an owner's home. General liability, property and an individual homeowner policy must be reviewed separately from board liability. HOA dues paying for association insurance do not automatically insure each home.

Self-managed and professionally managed HOAs both need clear responsibilities. Boards should review authority to move funds, access to resident records and management contracts. Crime protection, cyber coverage and a manager's own professional liability are separate checks; additional-insured wording does not solve every gap.

Common Claim Scenarios

Hypothetical examples, not reports of actual claims. Coverage depends on the allegations, facts and policy terms.

1

Architectural approval disputed

An owner alleges inconsistent enforcement after one renovation is approved and another rejected. The written rules, board record and policy exclusions need review.

2

Election process challenged

Members allege notice or ballot procedures were not followed and ask a court to overturn a board election.

3

Payment instructions impersonated

An email appears to come from the manager requesting a transfer. Review crime and cyber wording for impersonation and voluntary-transfer losses rather than assuming either applies.

What to Think About Before You Buy

Structure matters as much as price. These are the points we walk through with homeowners associations before placing coverage.

  • Review architectural and enforcement procedures alongside current disputes.
  • Confirm volunteer directors and relevant committees are within the insured definitions.
  • Ask whether defense expenses reduce the D&O limit and what retention applies.
  • Do not treat the manager's certificate of insurance as proof of the HOA's own coverage.

Homeowners Associations Insurance FAQs

What does HOA insurance cover?

The answer depends on the policies purchased and the property the HOA is responsible for. Property and general liability can address common-property losses and injury exposures. D&O addresses covered governance allegations. Crime, cyber and employment protection are separate questions, not automatic parts of an HOA policy.

Do HOA fees cover homeowners insurance?

Fees may fund the association's insurance, but that does not mean individual homes, belongings or personal liability are insured. Owners should review their own policy and the association's declaration and insurance summary to understand which property each is responsible for.

Can HOA D&O cover assessment or covenant-enforcement disputes?

It may respond to a covered allegation of a wrongful board act, but the policy can restrict particular disputes, remedies or loss categories. Review the complaint, exclusions, defense arrangement and reporting provisions before assuming coverage. Insurance does not make an unenforceable rule enforceable.

Are all volunteers covered under the HOA's D&O policy?

Not automatically. Directors, officers, committee members and other volunteers may be treated differently in the insured definitions. Confirm their role and the activities covered, along with exclusions and retention. Volunteer protections under law do not replace a policy review.

Does the property manager's insurance protect the HOA board?

Not necessarily. A manager's professional liability addresses its own work under its policy. The association should have its own appropriate protection and review the management agreement, indemnification and any additional-insured endorsements. A certificate is not the full policy.
